The following advertisement appeared in this week's edition of the Colorado Springs Independent. It is reproduced here because Biff is being threatened with a gag order in this lawsuit, which goes to hearing Monday, September 9. Biff feels this gag order is a backhanded effort by friends of Hefley to attempt to silence his campaign for Congress. It is notable that the Independent, KKCS, and the Boulder Weekly are not being sued. If Biff committed libel, then these media outlets would be culpable as well. Retired General Jay Garner and SY Technology have sued Libertarian Candidate Biff Baker for alleged libel.

The lawsuit, filed in the District Court of El Paso County, claims that Biff Baker falsely accused Garner and SY Technology of fraud, and is asking for millions of dollars in compensation.


Biff Baker was featured in a cover story in the Colorado Springs Independent on June 13th. Biff was also featured on KKCS-AM HotTalk1460's "On The Carpet" radio show with Chuck Baker on June 25th, and he appeared on the front cover of the Boulder Weekly on July 4th.

Biff states that he will fight this multi-million dollar corporation and their unethical President in court. Libel is an untruthful statement about a person, published in writing or through broadcast media, which injures the person's reputation or standing in the community. "Since everything I have said is true, then it isn't Libel!" said Biff.

Biff spoke out against a fraudulent sole source contract that was initiated by Space & Missile Defense Command (SMDC). The contract valued at $48 million was directed sole-source to SY Technology.

This is a violation of federal law 10 U.S.C. 2304, which mandates "full and open competition through the use of competitive procedures in accordance with the requirements of this chapter and the Federal Acquisition Regulation (FAR)."

Biff Baker was an Assessor with the Ground-based Midcourse Defense (GMD) Independent Assessment Team. However, when Biff blew the whistle on the fraudulent contract, General John Holly, from the Missile Defense Agency (MDA), fired him!

On March 17th, Biff notified members of the U.S. Senate and House Armed Services committees, the General Accounting Office, and Department of Defense Inspector General. The GAO and DOD IG are still investigating the matter with support of Senators Wayne Allard and Bob Smith (N.H.).

Congressman Joel Hefley, a member of the House Armed Services Committee, unethically refused to provide constituent services in support of Biff Baker's campaign against fraud. After 60 days of letters and emails, Biff Baker decided to run for Congress against Hefley.


* Biff notified the MDA of fraud.

* MDA fired him and "blacklisted" him from the missile defense program.

* After filing a complaint, the Baker family received death threats stating, "Drop it or you're dead".

* Out of concern for his family, Biff went public.

* After the Independent article on June 13th, the Baker family had another threat.

* Someone tried to ram his car on I-25 one day after; and a prowler(s) was in his backyard two days later.

* After notifying the Colorado Springs Police Department, Baker then took his family out of Colorado for a week for their safety.


"In my opinion, this is just an example of the good old boys taking care of their own. Jay Garner, President of SY Technology, got caught with his hand in the cookie jar. I caught him trying to cash in on a contract that was not open to bid. This is not only a violation of federal law, but also individual ethics. Conspiracy to commit fraud is also punishable under federal law."

Since MDA, SMDC, SY Technology, and their confederates were not able to keep a former Army Ranger, Biff Baker, quiet through fear and intimidation, they are now suing in an attempt to hush this whistleblower. It won't work!

BOTTOM LINE: The $48 million fraudulent contract was cancelled due to Biff's efforts! Retired General Jay Garner is merely seeking revenge through this frivolous lawsuit.

On The Joseph Michelli Show on AM 740 KVOR last Thursday, August 29, Joel Hefley told the Colorado Springs audience that he would not debate Libertarian opponent Biff Baker because he felt that Biff "was not at his level." Biff responded that Hefley was right—they weren't on the same level, but it was Biff that was far above Hefley, and not the other way around.

It appears once again that Biff was right. In today's (September 6) Gazette, Hefley says that he would not debate Biff, but now it is because "his decision is a matter of time," and that "there are better ways to get his (Hefley's) message out." Yet Hefley has enough "time" to spend two hours on the radio! This is typical Hefley, dodging debate whenever possible, and especially ducking Biff Baker.

So now Hefley says he doesn't have the time, and before he said Biff wasn't on his level. Hefley should make up his mind and tell the truth—he can't measure up to Biff, and he knows it.

Hefley told the Gazette, "So it's certainly no matter of fear about a debate." If that is so, then why won't Joel Hefley step up to the challenge?

Why, indeed. More evidence that Hefley is not running for re-election, just running scared. More to come…
